Lease Rent Reviews, Renewals, Re-gears and Variations
With in-depth specialist knowledge and acting for both Landlords and Tenants, this is a major and an increasingly complex area of our work. We maintain a close watch on emerging case law and Peter’s experience as an Arbitrator and Independent Expert is valuable in acting on behalf of Clients.
Peter is consulted by owners/developers/prospective purchasers on lease structures, particularly rent review provisions, which can have a significant impact on values.
As unexpired terms shorten, Peter is increasingly involved in advising on renegotiating lease terms in all sectors to the benefit of both sides.
Peter is actively involved in the cinema sector with over 20 multiplex or multiscreen cinema instructions active through 2015/16. These include rent reviews including the rent review of the Cineworld in the Xscape Yorkshire scheme for Land Securities Leisure.
With over 30 years involvement in the golf sector, Peter is acknowledged as a leading specialist on Landlord and Tenant matters.
Leisure Property Investment Advice
Peter has assisted in advising on a number of major leisure investment acquisitions providing detailed advice throughout. This advice has included providing input on rental values, lease structures, occupational trends and asset management potential.
Acting for The Crown Estate, Peter advised on the purchase of The Gate, Newcastle in 2012 and he remains involved in an asset management role and has acted on all rent reviews since purchase. Peter also advised The Crown Estate on the acquisition of MK1 Leisure Park.
In 2015, Peter advised on a number of leisure property investment acquisitions including , cinema-anchored leisure schemes at Crewe, Coventry Skydome, Blackpool, South Ruislip and Loughborough. Peter advised on the acquisition of Odeon investments at Huddersfield and Streatham by CBRE GI and provided advice for M&G on the acquisition of Bridgend Designer Centre. Peter also advised on the acquisition of the 50% interest in the O2. In each case, Peter worked alongside leading investment agents.
In addition to his extensive role in advising on rent reviews, Peter has experience in preparing evidence for Court hearings and planning inquiries – drawing upon in-depth knowledge and experience of the leisure property sectors.
Peter gave evidence at Planning Inquiry in respect of the addition of 3 casual dining restaurants to Legal and General Property’s Mansfield Leisure Park. Approval was granted.
A cinema impact assessment was provided to support a planning application on a scheme in Clacton and cinema viability reports have been produced for planning inquiries.
Acquisition and Sales
Close contact is maintained with the market place and discreet and confidential transactions can be ‘engineered’. Swift advice can be provided on sale and rental values and occupational demand.
We can also assist in planning and assisting widened marketing campaigns and we can work with larger agencies and add the necessary specialist input.
In 2014 advice was provided to the freeholder on the sale of London’s Trafalgar Studios on Whitehall to the tenant ATG.
Peter has remained involved on a number of acquired investments – advising upon the potential to enhance the schemes and add value.
Peter is currently advising funds on the re-gear of a number of multiplex cinema leases and the surrender of parts for development.
